The Kahnawake Gaming Commission entered the picture in the late 1990s, during a period when most gambling restrictions were in full swing. The Mohawk Council of Kahnawake enacted the Kahnawake Gaming Law in 1996 to establish the reservation as a territory with relaxed restrictions in which gaming operators could open their businesses and encourage growth in the territory.

The KGC would soon expand their regulatory authority to the digital realm right around the turn of the 21st century when internet access—and in turn, interactive gaming activities—became technically and financially viable.

  1. Client Provider Authorisation (CPA)

    The CPA is the licence that is most typically associated with a “casino licence,” which gives a company the authority to establish and operate an online gaming website within the jurisdiction of Kahnawake. A company that has received a CPA is called an Authorised Client Provider or ACP, and are allowed to offer players any of the typical forms of online gaming—online casinos, sportsbooks, and/or online poker rooms—as long as they have their site operations hosted by the holder of an Interactive Gaming Licence.

  2. Interactive Gaming Licence (IGL)

    The IGL is a special licence that gives its holder the authority to start and run a hosting facility for online gaming services within the Kahnawake territory. This must be accompanied with an application fee of C$35,000 for the CPA and another C$5,000 for every person that requires a KPL. Afterwards, the application goes through a due diligence period, during which the KGC drafts a report that will be submitted into the next possible meeting to make the final decision to approve or deny the application.

Upon approval of the application, further and more stringent auditing is done on the code of the casino site to ensure its compliance. The casino operator is given a preliminary permit to operate during this testing period, which can last up to 12 months. Once the casino site has been found to be in full compliance, the CPA is issued to the applicant and the operator is able to fully open their services to players. After this, the APC will be required to go under continuous compliance, receiving regular audits and paying an annual fee of C$10,000 to maintain the validity of their licence.

New Canadian Gaming Laws and the Future of the KGC

More recently, various provinces in Canada have begun to loosen their restrictions, particularly with online gambling laws in Ontario, which is set to open its doors to casino operators and online bookmakers in 2022. With other provinces seeking to follow suit, what would this mean for the future of the KGC, which until now has been the only regulator in the country that provides these licences in the first place?

From what we can tell, there shouldn't be too much of a difference.
